Waiver of Court Fees in Civil Cases

There are fees to file most court papers.  There is also a fee to serve court papers to parties on the other side of the case.  If you cannot afford the fees, you can ask the Court to have them waived or reduced.  Illinois Legal Aid Online provides a guided interview to help you prepare the documents required to request to file your papers for free or at a reduced cost.

Waiver of Fees/Assessments in Criminal Cases

When you are convicted of an offense in Illinois, the judge must enter a judgment requiring you to pay the costs of the prosecution. Assessments are costs charged to a defendant in a criminal case once found guilty.  They do not include fines or restitution.  They also do not include fee assessments resulting from violations of the Illinois Vehicle Code.  A Criminal Assessment Waiver may not apply to some court costs and fees associated with your case.

Illinois Legal Aid Online provides a guided interview to assist with preparing the documents required to ask the Court to waive or reduce criminal court assessments.  The forms work for all criminal cases, including felony and misdemeanor.  They do not work for traffic cases and other petty offenses in McHenry County.

Starting on January 1, 2024, if you are convicted and incarcerated, you cannot be ordered to pay any outstanding fines, costs or fees related to your criminal proceeding during the first 180 days after your release from incarceration.
